1. Who We Are
Techscale LLC ("Techscale," "we," "us," or "our") is a Florida limited liability company. We provide AI-powered communication software and services — marketed as the "AI Employee" — that answer phone calls, send and receive text messages, book appointments, follow up on leads, and manage reviews on behalf of small businesses, primarily home-services contractors.
This Privacy Policy explains what information we collect, how we use it, who we share it with, and what choices you have. It applies to:
techscale.us and any other website, landing page, funnel, or booking page we operate
The AI Employee platform and any related software, dashboards, or integrations
Phone calls, text messages, and other communications handled by our AI agents
Our sales and marketing activities, including outbound business-to-business outreach

2. Two Different Roles We Play
How we handle your information depends on which of two roles we are in. This distinction matters, so please read it.
When we act for ourselves (as a "controller"). This covers visitors to our website, prospective customers, and our own business clients. We decide what information to collect and why.
When we act for our clients (as a "processor" or "service provider"). When a home-services business hires us, our AI agents answer that business's phone line and text messages. The information belonging to their customers — callers, leads, appointment details — belongs to that business, not to us. We handle it only on their instructions and under our agreement with them.
If you called or texted a business and reached an AI assistant, and you want your information corrected or deleted, contact that business directly. They control it. We will support any request they send us, and you may also contact us using the details above and we will route your request to the correct business.
3. Information We Collect
3.1 Information you give us directly
Contact details: name, business name, email address, mailing address, phone number
Booking and scheduling information: appointment times, service address, job description, availability
Account and billing information: account credentials, plan selection, billing contact, and payment card details (processed by our payment provider — we do not store full card numbers)
Communications: the content of emails, form submissions, text messages, chat messages, and voicemails you send us
Anything you choose to tell our AI agent during a call or text conversation
3.2 Information collected automatically when you visit our website
IP address, approximate location derived from it, browser type, device type, and operating system
Pages viewed, links clicked, time on page, referring URL, and exit pages
Cookies, pixels, and similar tracking technologies (see Section 8)
3.3 Call and message data
When our AI agents handle calls and messages for a business, we process:
Caller phone number and caller ID information
Call audio recordings and AI-generated transcripts
The full content of SMS and MMS messages sent and received
Call metadata: date, time, duration, outcome, and disposition
Appointment bookings, quotes discussed, and follow-up tasks created
3.4 Information from third-party sources
For business-to-business sales and marketing, we obtain business contact information — company name, business address, publicly listed business phone numbers, business email addresses, job titles, and publicly available business listings — from commercial data providers, public web sources, and public business registries. This is used to identify businesses that may benefit from our services. It concerns people in their professional capacity, not their personal lives.
3.5 Information we do not want and do not seek
We do not intentionally collect Social Security numbers, government ID numbers, financial account numbers, health information, biometric identifiers, precise geolocation, or information about children. Please do not provide these to our AI agents or through our forms. If you do, we will delete it when we become aware of it.
4. AI Voice Agents, Call Recording, and Transcription
Please read this section carefully. It describes how our technology works.
4.1 You may be speaking with an AI
When you call a business that uses Techscale, your call may be answered by an automated AI voice assistant rather than a human. The voice you hear is synthetically generated. Our agents are configured to identify themselves as automated assistants, and you may ask to be transferred to a human or to end the call at any time.
4.2 Calls are recorded and transcribed
Calls handled by our platform are recorded, transcribed, and analyzed by automated systems in order to book appointments, capture job details, route messages, and improve service quality.
Florida is an all-party consent state for the recording of communications (Fla. Stat. § 934.03). Our agents are configured to disclose at the beginning of a call that the call may be recorded. By continuing the call after that disclosure, you consent to being recorded and transcribed. If you do not consent, hang up and contact the business by another method — email, web form, or in person — and it will assist you without a recording.
4.3 What happens to recordings and transcripts
Recordings and transcripts are stored in the client business's account, used to create appointments and follow-up tasks, and reviewed by the business and, where necessary for support or troubleshooting, by Techscale staff. They are processed by the third-party voice, speech-to-text, and language-model providers listed in Section 7.
4.4 AI outputs can be wrong
Our AI agents generate responses automatically and can make mistakes, including about pricing, availability, and scheduling. Nothing an AI agent says constitutes a binding quote, contract, or professional advice. Confirm important details directly with the business.
5. SMS and Text Messaging
5.1 Consent
We and our clients send text messages only to people who have opted in. You may opt in by submitting a web form, checking a consent box, texting a keyword to a listed number, providing your number during a phone call, or giving your number in person or in writing for the purpose of being contacted.
Consent to receive text messages is not a condition of purchasing any good or service.
5.2 Types of messages you may receive
Appointment confirmations, reminders, and scheduling changes
Technician dispatch and arrival notifications
Estimates, invoices, and payment links
Responses to inquiries you initiated
Review requests following completed service
Promotional or marketing offers, where you have separately consented to those
5.3 Message frequency, rates, and support
Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
To stop receiving messages, reply STOP to any message. You will receive one confirmation and no further messages from that program.
For help, reply HELP or contact us at [[email protected]] or [YOUR BUSINESS PHONE].
5.4 How we treat your mobile opt-in information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We share mobile numbers only with the service providers required to deliver the messages you have asked for (see Section 7), and only for that purpose.
6. How We Use Information
We use the information described above to:
Answer calls, respond to texts, book appointments, and follow up on leads on behalf of our clients
Provide, operate, maintain, and support the AI Employee platform
Create, update, and manage accounts and billing
Respond to inquiries, requests, and support tickets
Send service, transactional, and — where consented — marketing communications
Train our staff, monitor quality, troubleshoot errors, and improve the accuracy of our AI agents
Measure marketing performance and understand how our website is used
Detect, prevent, and investigate fraud, abuse, spam, and security incidents
Comply with legal obligations and enforce our agreements
We do not use client end-customer call recordings, transcripts, or contact data to train general-purpose AI models for our own benefit or to sell to others.
7. How We Share Information
We share information in the following circumstances, and no others.
7.1 Service providers
We use third-party vendors to run the platform. Each has access only to the information needed to perform its function, and is bound by contract to protect it. Categories and representative providers include:

7.2 Our clients
If you contacted a business that uses Techscale, we share your information with that business. That is the purpose of the service.
7.3 Legal and safety
We may disclose information if required by law, subpoena, court order, or government request, or where we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
7.4 Business transfers
If Techscale is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a materially different privacy policy.
7.5 What we do not do
We do not sell your personal information. We do not rent it. We do not share it with third parties or affiliates for their own marketing or promotional purposes.
8. Cookies and Tracking
Our website uses cookies and similar technologies to keep the site working, remember your preferences, understand traffic, and measure the performance of our advertising.
Most browsers let you refuse or delete cookies through their settings. Blocking cookies may cause parts of our site to stop working correctly. Because there is no common industry standard for honoring them, we do not currently respond to browser "Do Not Track" signals.
9. Data Retention
We keep information only as long as we need it:
Call recordings and transcripts: retained for the term of the client's subscription and for [90 days / 12 months — SET YOUR PERIOD] after, unless the client instructs us to delete them sooner
Contact and CRM records: retained for the term of the client's subscription and for [12 months — SET YOUR PERIOD] after termination
Billing and tax records: retained as long as required by law, generally seven years
Opt-out records: retained indefinitely, because we are required to honor your opt-out permanently
Website analytics: retained per our analytics provider's default period
When a client terminates, we delete or return their data in accordance with our agreement with them.
10. Your Rights and Choices
Regardless of where you live, you may ask us to:
Access the personal information we hold about you
Correct information that is inaccurate
Delete your information
Opt out of marketing emails (click unsubscribe) and text messages (reply STOP)
Obtain a copy of your information in a portable format
To make a request, email [[email protected]] with the subject line "Privacy Request." We will respond within 45 days. We may need to verify your identity before acting, and we may not be able to fulfill a request where the law requires us to retain the information.
We will never discriminate against you for exercising these rights.
A note on scope: the Florida Digital Bill of Rights applies only to companies with more than $1 billion in global annual revenue that meet additional criteria, so its formal obligations do not apply to Techscale. We offer the rights above voluntarily to everyone. Residents of California, Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws may have additional statutory rights; contact us and we will honor applicable ones.
If your information was collected by our AI agent on behalf of a business you contacted, that business controls it. Contact them directly, or contact us and we will forward your request.
11. Security
We use reasonable administrative, technical, and physical safeguards to protect information, including encryption in transit, access controls, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and any applicable regulator as required by Florida law.
12. Children's Privacy
Our services are intended for businesses and adults. We do not knowingly collect personal information from anyone under 18. If we learn we have collected information from a child under 18, we will delete it. If you believe a child has provided us information, contact us at [[email protected]].
13. Third-Party Links
Our website and messages may link to sites we do not operate. We are not responsible for the privacy practices of those sites. Review their policies before providing information.
14. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the revised version here and update the "Last Updated" date. If the changes are material, we will provide additional notice, such as by email or a notice on our website. Your continued use of our services after the effective date means you accept the updated policy.
